When the European Court of Human Rights imposes on the States the starting point of the limitation periods for the actions for compensation in physical integrity

Considering that the limitation periods for the actions for compensation have to take into account the case of victims whose diseases can only be diagnosed many years after the pathogenic events, the European Court of Human Rights imposes in practice on the States to set the outbreak of the damage as the starting point of this period. The general character of such a rule necessarily raises questions with regard to the recent reassertion of the principle of subsidiarity.
