The principal reproach which can be made with the judgement Cusan and Fazzo v. Italia of January 7, 2014, is not certainly to have given a place to the agreement of the parents about the attribution of family name to their children, but initially not to have discussed the function of the name in the European cultures, then to have confused equality and identity of paternity and maternity.
