In the judgement Vinci Construction et GTM Génie Civil, France was condemned for failing to comply with articles 6, § 1, and 8 of the European Convention on Human Rights in relation to searches and seizures in undertakings investigated for alleged infringements to competition law. The Court held that undertakings must be granted an effective remedy against inspection decisions. In addition, seizures cannot be massive as well as undifferentiated, and the lawyer-client relationship must be protected.
