Derogations in exceptional circumstances: a grey hole

This contribution focuses on the regime of derogations in exceptional circumstances. While international law initially tends to a « dualistic » model, in which there are two applicable body of rules, one for the « normal » times and one for « exceptional » times, certain decisions, and notably at the European level seems to question the paradigm of the international regime of the state of exception.
