The freedom of expression of members of parliament and the maintenance of order within the hemicycle

In its ruling in Karacsony et al. v. Hungary, the European court of human rights Grand Chamber adresses for the first time restrictions of freedom of expression linked to the adoption of disciplinary sanctions towards members of parliament. This article seeks to comment and learn from this ruling. It highlights namely an everincreasing jurisprudential tendency of the Court – the proceduralisation of fundamental rights – and the questions raised by this movement.
