The Court of Strasbourg demands the establishment by the States parties of a “medical asylum” procedure

The Court, by extending the applicability of Article 3, prohibits the removal of seriously ill aliens when, on account of the absence of appropriate treatment in the receiving country, they face a risk of an irreversible decline in their state of health, without requiring an imminent risk of dying. Moreover, the Court recommends the establishment of « appropriate procedures » to verify whether the care available in those countries is sufficient and appropriate.
