The French Constitutional Court judges that the Civil Code Articles related to marriage, interpreted by the Court of Cassation as allowing heterosexual couples only to marry, are not against the Constitution. Thus the Constitutional Jurisdiction validated the interpretation of the judicial judge and let the legislator take charge of the advance some other European countries have already made. The French Constitutional judge and the European Court of human rights both stand on the same position, but it remains to be seen whether this position will, in the future, be questioned by the case law of the Court of Justice of the European Union.
