The Adamov case (Adamov v/ Switzerland) and the fairness principle

A Russian citizen has come voluntarily in Switzerland in order to meet an investigating judge. Can he be arrested while the 1959 European Convention on Mutual Assistance in Criminal Matters prohibits the arrest of a person convened as a witness? According to the Europ. Court H. R., the 1959 Convention does not apply because the Russian citizen has not been called when he was in Russia. His arrival in Switzerland was purely voluntary. Consequently, his arrest did not breach Art. 5 of the ECHR. However, as this Russian citizen had had informal contacts with the judge prior his arrival in Switzerland, his arrest raises some issues of fairness.
