The recognition of the right for the conscientious objection by the european Court of human rights.

The european Convention is an alive instrument which must be interpreted towards the current conditions. It is what confirms the ruling returned in the case of Bayatyan in which the Court in Grand Chamber realizes one reversal of case law to connect with the guarantees of the article 9 of the European Convention of Human Rights the right for the conscientious objection. In this updating of the conventional system, the Court reveals a construction which could weaken the pillars which support the implementation of the protected rights.
