In the Eweida case, the European Court uses for the first time its control on interferences and respect of state positives obligations in the right to manifest one’s religious beliefs in the workplace. Positive manifestations such as the wearing of religious symbols have a relative conventional warranty. In contrast, negative manifestations following the path of conscientious objection are more difficult to ensure when they conflict with a legitimate objective of promoting equality. However Pandora’s box is open !
