The Jurisdictions of the European Union and the Fundamental Rights - Case-law Review (2013)

Intended to analyze sources and significance of the protection of the fundamental rights in the case-law of the Court of justice, this annual review is divided in six parts corresponding to the titles of the Charter of the fundamental rights : I. Freedoms, II. Equality, III. Citizens’ rights, IV. Solidarity, V. Justice and VI. General provisions. During year 2013, of particular importance is the search for a real effectiveness of the right to the jurisdictional protection of the persons suspected of being involved in terrorism, the importance attached to the protection of personal data of the European citizens, the highly protective approach of the rights of the homosexual persons, whether it is about the asylum or about the burden of proof on the ground of non-discrimination, either still the extensive perception of the Charter’s scope.
