Certain national judges often show a voluntarism that is quite remarkable in the way they implement the law on the European Convention on Human Rights and the way they accept the jurisprudence from the European Court of Human Rights. An example of this is that the French Court of Cassation via its highest entity, almost attributed itself the stature of official body of the European Council by approaching member states of the Convention to specify to them that they have an obligation to respect the decisions of the European Court of Human Rights, without waiting to be pursued by the Court or to be asked to modify their legislation. This approach inevitably raises several questions that arise from the fact that it is sometimes difficult to fully grasp the meaning of the European Court’s jurisprudence, and to interpret and implement some of the concepts behind the law of the Convention and also arise from the individual missions that national judges have within their country’s legal system. The decree of December 4, 2013 from the French Cassation Court is a fine example of such a situation, where the stakes are as important for the conventional system which thereby benefits from the judge’s attention, as for the internal system that finds that its predictions are neutralized.
