Article 5 of the Convention is particularly strict in its implementation, but relatively flexible in the definition of its scope. As illustrated by the commentated decision, the Court has integrated in the definition of the « deprivation of liberty » an element of proportionality that allows for this provision not to be applied in « mild » cases of detention. However, this approach presents certain risks.
